Terms of Service for “learn.brightideas.agency”

Welcome to the Bright Ideas Agency LLC online learning platform (learn.brightideas.agency).
These Terms of Service ("Terms") govern your use of our learning platform, including all content, services, and features available through the platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our platform.
1. Use of the Platform
- You must be at least 18 years old or have parental consent to use our services.
- You may only access this site and content where registering to access learning content is legal in your jurisdiction.
- You agree to use the platform only for lawful purposes and in compliance with these Terms.
2. Platform management
- Bright Ideas Agency provides its learning platform through Thinkific. Certain functions such as payments are conducted by Thinkific on Bright Ideas Agency’s behalf. By using this platform you consent to your data being processed by Thinkific in accordance with its Terms of Service and Privacy Policy.
3. Data Processing
- In addition to processing by the platform, data you share with us may be processed by us and by third parties in relation to the execution of the services related to these Terms. This includes, but is not limited to, communications including emails to provide updates to you and other related purposes. For more information, see our Privacy Policy.
4. Account Registration
- To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, complete, and up-to-date information during registration.
- Your individual user account and associated accessible courses or other assets are for your sole use. Sharing of account credentials is not authorized. If you need access to your training content for a larger number of people you must purchase additional licenses.
- For live training programs you must provide a valid email address that will be used for course communications. This email address will be used to access live sessions through Microsoft Teams or any other chosen platform.
- Live training: In addition to course registration, to attend live training programs you must have access to a suitable device and internet connection at the time of that program. In general, live training will be delivered via Microsoft Teams. You are solely responsible for ensuring you are able to access these sessions.
5. Payments and Refunds
- All payments for courses are processed securely using Thinkific’s payment processing platform.
- If you are an individual and you are not 100% satisfied with your purchase during the first seven days following purchase reach out to learn[at]brightideas.agency requesting a no quibble refund. After 7 days refund requests will be processed on a case-by-case basis.
- Unless otherwise stated all one-time course registration purchases provide 90-days access to the training (in the case of live sessions this shall apply to any recordings that are included) which may be renewed depending on the on-sale status of that course. Monthly subscriptions provide month-to-month access until cancelled or until the product is withdrawn (whichever comes first).
- Live training: The refund policy does not apply if either of these conditions is true: (1) any sessions on your course have already taken place or (2) less than two business days remain until the live sessions commence. Refund or rescheduling requests will be considered on a case-by-case basis based on the circumstances outside of these conditions. Contact learn[at]brightideas.agency to discuss your options.
6. Intellectual Property
- All content on the platform, including courses, videos, and materials, is owned by Bright Ideas Agency or its content creators and is protected by copyright laws.
- You may not reproduce, distribute, or modify any content without prior permission.
7. Termination
- We reserve the right to suspend or terminate your account for violations of these Terms.
- Disruption or inappropriate behavior in live sessions will result in immediate removal and account termination. Inappropriate behavior includes disruption, lewd or crude language or comments, harassment, sexual language or suggestions, or any behavior that could reasonably be construed, at the sole discretion of the host, to compromise the ability of other participants to fully engage with the session.
- No refunds are provided to users whose access is terminated due to behavioral violations or failure to comply with these Terms.
8. Limitation of Liability
- Bright Ideas Agency is not responsible for any indirect, incidental, or consequential damages arising from your use of the platform, your participation in our training or communities, or any issues that arise in relation to your learning with us. You agree to defend and hold harmless Bright Ideas Agency, its owners and representatives, and any contractors or service providers involved in the delivery of these services from any claim, monetary or otherwise, resulting from the actions taken in or connected to the delivery of the services under this agreement.
- Bright Ideas Agency is not responsible for any third-party technical failures that impact its ability to deliver these services.
9. Rescheduling or Changes
- From time-to-time due to unforeseen circumstances it may be necessary to reschedule live training or events that are part of courses or communities. Where this is the case, the maximum notice possible will be provided and rescheduling will occur as soon as it is practical. Where necessary, refunds will be offered if a session cannot be rescheduled during a reasonable timeframe.
- For live courses, we reserve the right to cancel or reschedule programs that fail to meet a minimum viable number of participants. In this case, you will be offered access to a later occurrence of the same course or a full refund (your choice).
10. Changes to Terms
- We may update these Terms occasionally. Continued use of the platform indicates acceptance of the updated Terms.
